National Green Tribunal (NGT) of India – What you need to Know (History,Challenges,Circuit Benches,Necessity)

India has become the third country in the world to start a National Green Tribunal (NGT) which is a judicial body exclusively meant to judge environmental cases.Note Environment has become the one of the most important issues in the country affecting the broader society.Alongwith Land Acquisition,environment has become the most frequent conflict flashpoint.There have been numerous case where large industries have been confronted by local people fighting for the environement.Recent cases like the Vedanta Bauxite smelter in Orissa,Thermal Power Plants in Andhra Pradesh,the Jaitapur Nuclear Power Plant in Maharashtra have seen huge controversy and protests.Note Vedanta Resources has found itself in the centre of controversy over mining bauxite in Niyamgiri Hills which are held sacred by the Dongria Kondh tribal group.With powerful political and bureaucratic patrons,Vedanta has managed to ride roughshod over Tribal Rights. Having a National Green Tribunal (NGT) has become essential for the country so that development can proceed with peace between various stakeholders .Note normal judges and courts don't have the expertise to understand the massive complexities and intricacies involved in billion dollar industrial projects and their impact on the environment.The NGT will have each judge having an environmental expert to guide him/her on the ecological issues so that they can come to an informed judgment.

India's Supreme Court took the matter of hundreds of billions of dollars of Black Money stashed into foreign bank accounts into its own hands as the government has repeatedly failed to take any action stalling the case.The Indian government led by the Congress Party has been repeatedly blasted by the Supreme Court for not acting against corruption matters.Recently the Court in an unprecedented move took over the supervision of the CBI in 2G Telecom Scandal Case Investigation.Note CBI is under the Home Ministry and like other investigations was being tardy to take action government ministers.The 2G Telecom case has resulted in top ministers and corporate CEOs being jailed with prospects of more being convicted.

Fly Ash Water Pollution lead to NTPC Thermal Power Plant Shutdown in Talcher,Orissa

Fly Ash Pollution of nearby water bodies had forced the Orissa State Pollution Control Board (OSPCB) to issue a notice to the massive 3000 MW NTPC Talcher Thermal Power Plant.While the notice asked for immediate shutdown of 4 untis of 500 MW,NTPC has only closed down 1 unit citing that closing more units will lead to massive power disruptions in nearby states.The action comes following NTPC bad fly ash managment system which has led to two past incidences of water pollution.There was a danger that the massive amounts of fly ash being generated would lead to breakdown of the storage dykes and lead to more pollution.

Directorate General of Hydrocarbons (DGH) – Regulatory Capture by Big Indian Oil/Gas Companies,CBI files Case (V K Sibal),CAG finds Massive Corruption (Gold Plating Reliance)

Note Indian ministries and regulators have been found to be massively corrupt with the 2G Telecom Scandal facing the glare from the Supreme Court .Huge loss has been caused by ministers,corporate CEOs and various politicians a number of which are in jail right now.The CAG report had said that Reliance had doubled its cost in the KG-6 Basin leading to a huge loss for the Indian government.A number of other lapses (intentional) has been found by the DGH and the Ministry each time favoring the private oil and gas companies in India.Now the CBI has filed a case of corruption against the the former chief of the DGH V K Sibal for scuttling a probe by the Central Vigilance Commission (CVC) for showing undue favors to the private companies.Note India has been stuck by a number of scams in the stock market pertaining to mid cap and small caps.This has led to huge losses for investors with some companies like Reliance Telecom,Unitech having over 90% of their share values eroded.Reliance the biggest Indian company by market capitalization might be facing the same fate if the investigative agencies and the courts do their jobs.

Proprietary Trading by Foreign Banks and Brokerages has been allowed by the Finance Ministry overruling India's Central Bank RBI.There seems to be no logical reason given by the Ministry despite RBI objecting saying that it will affect the financial stability and lead to increased speculation in the Indian stock markets.Note Properietary Trading refers to trading in financial assets by investment banks using their money and has come under the regulatory glare in the US.Huge conflicts of interest arise due to this practise as brokerages can indulge in front running and other unethical and illegal acts.Already major investment banks like Goldman have been fined hundreds of millions of dollars over improper trading acts.Proprietary Trading encourages brokerages to mislead and defraud customers as they are generally on the other side of the trades and advising them as well.

Solar Subsidy in India Bias of Large Solar Farms unwisely goes against the Global Trend of Rooftop Solar System Support

India's JNNSM on the other hand has seen the first phase marked by a number of teething problems like debt financing,absurdly low bidding by noname companies,poor electricity infrastructure.The Second Phase is supposed to ally these problems but the first plans do not seem to be too great.The support for large solar farms will be increased from the current 5 MW cap to 20-25 MW cap.This will lead to only large investors,utilities and companies being left in the fray and lead to lesser competition.Also there is no support for rooftop solar which will help to broadbase the reach of solar energy.A Policy which helps distributed solar like Germany will do much more to boost solar in the country than supporting massive solar plants that will only help large companies making the most of the taxpayer subsidies.Note Delhi is the only state in India which is giing primacy to rooftop solar systems and is in the process of announcing a capital subsidy soon.The reason may be that Delhi mostly consists of urban homes and they have little option.

India's Largest Company Reliance Stock Dives on Corruption collusion fears with Oil Regulator (DGH),Ministry in Season of Scams

Now India's Largest Company Reliance too has seen its stock fall to a post Lehman low on concerns that it has colluded with the Oil Regulator and Ministry to gold plate its costs in the KG 6 Gas concession.Reliance is India's biggest oil and gas company with interests throughout the supply chain.Note its nothing new as Reliance has always been known to be the most powerful corporate in India .However with the government's own auditing department CAG raising allegations of collusion and corruption,Reliance too may find itself snared in the corruption scandal.Note the infamous Nira Radia tapes had ample proof of how the powerful Reliance group manages the appointment of its favored persons in key federal ministries.The company must now by hoping that the Supreme Court which is already preoccupied with a ton of corruption cases does not take a keen interest and gets the CBI to investigate the allegations.

India sees a Flash Crash as Nifty crashes by 3% in 10 minutes as Mauritius might lose Tax Haven Status

The Indian Stock Market saw a flash crash on the morning of 20th June at 10 am.The market which started weak at 9 am fell by almost 3% in 10 minutes.The main index Nifty which was trading at around 5350 crashed to around 5200 in around 10 minutes.The market recovery by 1% but is again starting to go down to the low levels fo 5200 .Note the Indian stock market has been hammered due to worries on inflation,massive endemic corruption which is facing protests from the civil society.The FIIs which are the main buyers of Indian equities in the last year or so seem to have abandoned the Indian stocks as QE2 starts ending and global risks like Greece,US slowdown,inflation and interest rates worries in emerging markets come to the fore.Note Indian stock markets are not the easiest to invest in with scams and scandals happening regularly and it at best remains a market in which you have to choose between the bad and the ugly.

Top European Wind Companies Vestas,Gamesa and Enercon have gained marketshare in 2010 in the Indian Wind Power Market.Note Indian Wind Energy Companies have been competing with each other as the Indian Wind Power Market starts slowing down.India installed more than 2 GW in Wind Capacity and is the world's fifth largest market.Suzlon the biggest Indian Wind Turbine Company has seen its marketshare go below 50% for the first time to 41% as aggressive initiatives by foreign wind manufacturers pay off.Note GE,Siemens and others have been setting up blade and turbine factories in India to lower costs and improve their position.Gamesa has been the biggest winner by gaining a 10 percent marketshare taking the No.3 position from the world's largest wind turbine company Vestas.Enercon maintaines its 2nd position with 500 MW of installations despite severe legal problems between the domestic unit and the German parent.

India's Agricultural Loan Interest Subsidy Perversity- How Rich Farmers Make Risk Free 3-5% Carry using Zero Capital

India's policymaker keep making dumb policies to promote agriculture in the country which leads to huge losses for taxpayers and leads to no gains for poor farmers.One such policy is to give a interest rate subsidy of 3% to farmers who have repaid their loans.This means that if you are getting a loan from the banks at 7.5% normally,you will now get it at 4% if you are a farmer who has repaid his loans.Note the condition "repaid his loan" is meant to sound as it he has great thing like saving someone from a burning building.Last time I though all loans were meant to be repaid.But evidently different rules apply to farmers who were in the election year in 2009 were given a loan waiver.The government effectively allowed the farmers to convert their loans to a grant.It was an indirect gifting of billions of dollars to farmers to get votes and it worked splendidly for the ruling Congress party.A winning idea is seldom abandoned even it leads to perverse economic outcomes.

CERC to increase Renewable Purchase Obligation (RPO) frequency compliance to facilitate lumpy REC Trading

Central Energy Regulatory Commission (CERC),India's Electricity Regulator is planning to increase the frequency of compliance of the Renewable Purchase Obligation (RPO) for states from an annual affair to a bi or quad annual affair.Note Renewable Energy Certificate (REC) Trading in India started in 2011 to facilitate the development of the Renewable Energy Industry in India.According to the RPO,a certain percentage of a state's electricity generation must come from clean energy sources.States and utilities which can't meet their renewable energy requirements can buy REC from Indian Energy Exchanges to meet their needs.Power Exchanges in India have already set the ball rolling in terms of trading in RECs.
